Although we owe nobody an explaination, I will give one to you (and I am
sure that Joe will respond to this as well)...

You do not need source code to steal code.  You can generate source code
from many different disassemblers for the Amiga.  We use Resource
ourselves.  This program turns executable into code that you can load
into any assembler and assemble it.  It is not illegal to disassemble
code, but it is illegal to use any code that was not written by you
without permission of the copyright holder.

Since the very first version of ShapeShifter, Christian has stolen code
from both AMAX IV and EMPLANT.  If you disassemble ShapeShifter's
PrepareEmul and RsrvMem, you will find that much of the code is byte for
byte identical.  You wil also find the same for MANY sections of code,
like sound, force quit, the 060 support code, etc... all identical.

Christian has publically stated that more than 10,000 people have
registered ShapeShifter.  At $40USD each, that equates to $400,000.  My
suit is for this amount in damages, and the German law also requires
same amount in potentially lost revenue, so another $400,000 for a total
of $800,000 plus whatever damages that the judge might award.

Fortunately, the German laws work in a friendly way in that the judge
decides the entire case.  Source code (diassembled code) is compared and
either it violates copyrights, or it doesn't.. simple as that.  No
attorney is required *unless* I want to seek criminal justice, which
would place Christian in prison for a term of not more than 5 years.  I
am not going to do this, I just want Christian to never touch a computer
ever again.

Because of the theft of our code (as well as AMAX IV), Christian was
able to develope knowledge that he would have never been able to obtain
without the theft.  For this reason, my injunction is against
ShapeShifter, Basilisk, and SheepShaver.
